Welcome to IsItMonitored, operated by PMC Org.936901379 ("we", "us", or "our"). By accessing or using our website, platform, and services (collectively, the "Services"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not use our Services.
1.1 Eligibility: You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or the entity you represent.
1.2 Acceptable Use: You agree to use the Services only for lawful purposes and in accordance with these Terms. You shall not:
2.1 Our Property: The Services, including but not limited to software, code, designs, text, graphics, logos, and trademarks, are the exclusive property of PMC Org.936901379 (operating as IsItMonitored) and its licensors and are protected by copyright, trademark, and other intellectual property laws.
2.2 Your Data: You retain all rights, title, and interest in and to the data you submit to the Services ("User Data"). You grant IsItMonitored a limited, non-exclusive license to use, copy, transmit, and display User Data solely to the extent necessary to provide and improve the Services.
2.3 Feedback: You acknowledge and agree that any questions, comments, suggestions, ideas, feedback, or other information regarding the Services ("Feedback") provided by you to us are non-confidential and shall become our sole property. We shall have a royalty-free, worldwide, transferable, sublicenseable, irrevocable, perpetual license to use or incorporate into the Services any Feedback.
3.1 Plans: The Services are offered under multiple subscription tiers (Free, Starter, Compliance, and Enterprise). Features, limits, and pricing for each tier are described on our Pricing page.
3.2 Billing: Paid subscriptions are billed monthly in advance. All fees are quoted in US Dollars (USD) and are non-refundable except as required by applicable law or as expressly stated herein.
3.3 Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings or by contacting us.
3.4 Plan Changes: Upgrades take effect immediately. Downgrades take effect at the start of the next billing period. Upon downgrade, features exceeding the new plan's limits may become inaccessible.
3.5 Refunds: We do not offer refunds for partial billing periods. If you believe you have been charged in error, please contact us within 30 days at legal@isitmonitored.com.
4.1 Uptime Target: We target 99.9% platform availability, excluding scheduled maintenance windows. Scheduled maintenance will be communicated in advance where practicable.
4.2 Enterprise SLA: For Enterprise customers, specific service level commitments and remedies are defined in your individual Order Form or Service Level Agreement and shall take precedence over this section.
4.3 No Guarantee: Notwithstanding the above targets, we do not guarantee uninterrupted or error-free operation of the Services. See Section 6 (Warranties and Disclaimers) for details.
5.1 Privacy: Your use of the Services is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information.
5.2 Data Processing Agreement: Where you use the Services to process personal data of third parties (e.g., employees, vendors, or clients), a Data Processing Agreement ("DPA") governs our obligations as a data processor under GDPR Art. 28. To request a DPA, contact legal@isitmonitored.com.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ISITMONITORED DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
You agree to defend, indemnify, and hold harmless IsItMonitored and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the Services; (b) your violation of any term of these Terms; or (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ISITMONITORED BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
IN NO EVENT SHALL ISITMONITORED'S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES EXCEED THE GREATER OF ONE HUNDRED EUROS (€100) OR THE TOTAL AMOUNT PAID BY YOU TO ISITMONITORED FOR THE SERVICES IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
9.1 By Us: We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
9.2 By You: You may cancel your account at any time through your account settings or by contacting us.
9.3 Effect of Termination: Upon termination, your right to use the Services will immediately cease. Your User Data will be retained for a period of 30 days following termination, during which you may request an export. After this period, your data will be permanently deleted unless retention is required by law or by the data retention terms of your subscription plan.
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a prominent notice on our platform at least 14 days before the changes take effect. Your continued use of the Services after the effective date constitutes your acceptance of the revised Terms. If you do not agree with the changes, you must stop using the Services and cancel your account.
These Terms shall be governed by and construed in accordance with the laws of Norway, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Oslo, Norway.

12.1 Entire Agreement: These Terms, together with the Privacy Policy and any applicable Order Form or DPA, constitute the entire agreement between you and PMC Org.936901379 regarding the Services and supersede all prior agreements and understandings.
12.2 Severability: If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
12.3 Waiver: The failure of IsItMonitored to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
